3. AI Generated Content

CloakAI uses artificial intelligence technologies to generate interview assistance, suggestions, summaries, transcripts, and related outputs.

AI generated responses may contain inaccuracies, incomplete information, outdated material, or incorrect recommendations.

Users remain solely responsible for reviewing, validating, and deciding whether to rely on AI generated outputs.

CloakAI does not guarantee interview success, employment offers, career advancement, or accuracy of generated responses.

4. Accounts and Registration

Users may be required to create an account in order to access certain features of the platform.

You agree to provide accurate and complete information and to keep your account information updated.

You are responsible for all activity that occurs under your account.

5. Account Security

You are responsible for maintaining the confidentiality of your login credentials and account access.

You agree to notify CloakAI immediately if you become aware of any unauthorized access, security breach, or misuse of your account.

6. Subscription Billing

Certain features of CloakAI require a paid subscription.

Payments are securely processed through Stripe. CloakAI does not store full payment card details.

Paid subscriptions renew automatically unless canceled before the renewal date.

Pricing, plans, and available features may change at any time.

7. Refunds and Cancellations

Users may cancel subscriptions at any time through their account settings or payment provider.

Cancellation prevents future renewals but does not automatically provide refunds for previously billed periods unless required by applicable law.

Refund requests may be reviewed on a case by case basis for duplicate charges, billing errors, or major technical failures.

8. User Uploaded Content

Users may upload resumes, CVs, job descriptions, screenshots, transcripts, audio recordings, and other materials in connection with the service.

You retain ownership of your uploaded content.

By uploading content, you grant CloakAI a limited license to process, store, analyze, and display such content solely for operating, improving, and maintaining the service.

9. AI Service Providers

CloakAI may use third party providers including OpenAI, Anthropic, Google, and Stripe to deliver platform functionality.

By using the platform, you acknowledge that certain user content may be securely processed through these providers for the purpose of delivering the service.

10. Prohibited Use

Users may not:

• Use the platform unlawfully
• Attempt unauthorized access to systems or accounts
• Upload malicious software or harmful content
• Interfere with platform security or availability
• Use the platform for fraud, deception, or abuse
• Violate intellectual property rights
• Reverse engineer or exploit the service

11. Interview Compliance Responsibility

Users are solely responsible for ensuring that their use of CloakAI complies with employer policies, interview rules, contractual obligations, and applicable laws.

CloakAI is not responsible for employment decisions, disciplinary actions, failed interviews, or consequences arising from platform usage during interviews or assessments.

12. Fair Use Policy

CloakAI reserves the right to limit excessive or abusive usage that negatively impacts platform performance, infrastructure, or other users.

13. Privacy Policy

Your use of CloakAI is also governed by our Privacy Policy and Cookie Policy, which explain how personal data is collected, processed, and protected.

14. Service Availability

We do not guarantee uninterrupted, secure, or error free access to the platform.

Maintenance, updates, outages, third party failures, or technical issues may temporarily affect service availability.

15. Disclaimer of Warranties

CloakAI provides the service on an “as is” and “as available” basis without warranties of any kind, whether express or implied.

We do not warrant that the platform will always be available, accurate, secure, or free from defects or interruptions.

16. Limitation of Liability

To the maximum extent permitted by applicable law, CloakAI shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, loss of data, business interruption, or loss of opportunity arising from the use of the service.

Nothing in these Terms excludes liability that cannot be excluded under applicable law, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence.

17. Indemnification

You agree to indemnify and hold harmless Lussy Company Limited, CloakAI, its affiliates, directors, employees, contractors, and agents from claims, liabilities, damages, losses, and expenses arising from your use of the service, violation of these Terms, or infringement of third party rights.

18. Termination

We may suspend or terminate access to the service at any time if users violate these Terms, abuse the platform, or create security or legal risks.

Users may stop using the platform at any time.

19. Changes to Terms

We reserve the right to modify these Terms at any time.

Updated versions will be published on the website with a revised effective date.

20. Governing Law

These Terms shall be governed and construed in accordance with the laws of England and Wales.
